Terms and Conditions

Hi! It seems you are using my little short story website, welcome! You might be here to read a story, connect with other bookish folk in the reader/writer forums or doing a bit of retail therapy. I invite you to do all these things but, while you are here, you agree to the following terms and conditions. If you do not agree to these conditions, you can of course opt out by closing this site. 

This site is all about reading and writing and is a very small operation (i.e. just me, hi, hello!) Despite being a tiny little bookish site, I still have to put rules in place so things work smoothly. These rules are there to protect you, to provide an understanding of the terms of using this site as well as protect me from theft, liability and loss.  

What The Readily provides

The Readily provides interactive short stories that are free to read. Around 100 words are published Monday to Friday and readers are given until 5pm (BST) to cast their vote for what happens next. The story will then continue the next week with the winning option in the same format. Each story will last 4 weeks before a new story starts. In some cases, due to other commitments and this site being a one-woman show (with said woman having a day job, studies to complete and novels to write), stories may occasionally need to be delayed or skipped - I will let readers know if this is the case.  

In addition to providing entertainment in the form of short stories, The Readily also offer a community platform for readers to engage in conversation about the short stories published on this site, other bookish things and writing questions and advice. The community are not experts (well, some might be, but I can't guarantee that). Whilst we are all here to share our love of stories and support each other, if you require proper, really real professional advice this is not the place to find it!  With all that being said, by accessing materials on this site, using the community feature and purchasing products, you agree to everything in these terms and conditions. And, whilst I understand that not many people actually read these things, you as a user are bound by these terms and conditions all the same. These T&C's cover you, us, and all other people using this site.
 

Using The Readily

Stories on The Readily are for adults - there may be swearing, and themes that are not suitable for children. Therefore, you will be over 18 to use this site. 

I do my best to make sure everything is accurate and error-free in my work and associated research but I can’t guarantee it. I apologise in advance if you do find errors within the content of this site but I disclaim any liability for mistakes in my content.

Your account on The Readily

If you wish to place orders or access the community features on The Readily, you have to create an account. When you create an account, you will use legal and accurate information (for example, you will not present yourself as someone you are not!)

You must be over 18 to create an account. Please do not create an account if you are under 18. I am not accountable for other community users content and this age limit is in place to keep you safe. 

You are accountable for your own financial responsibilities. Please do not place orders / offer support if you cannot afford it and do not use others' funds to support your spending habits. Any external links or offers posted by other users within the forums should be treated with caution and you should consider any risks before clicking any external links or take an offer provided by a community member (remember, if it sounds too good to be true, it usually is). I accept no liability regarding external links and offers made by community users for advice/support/goods/services etc. 

The law and stealing my (and other users) content

Creators have enough problems with data scraping and AI. Don't add to the problem by breaking the law yourself and stealing others' intellectual property. I work hard on creating content FOR FREE, so be kind, ethical and law abiding and find your own stories to tell.

 

By using this site you agree to the following:

 

You won’t copy or re-use my stories, blog posts and other content posted on this site. 

You won't copy or re-use any content posted by community users or guest writers that may publish on this site.

You won’t post anything abusive, defamatory, threatening, libellous, invasive or otherwise objectionable.

You won’t post anything or use my content for anything that would constitute a criminal offence or violates any laws.

Refusal of service

I reserve the right to refuse access to services to any members. Refusal of service may be invoked for the following reasons (inclusive but not limited to):

  • Copying my content

  • reasonable suspicion that you are copying my content

  • Rude or abusive behaviour directed at myself or any member of The Readily community

  • Refusal to abide by rules set out here, in the private policy and within the forums

  • Any behaviour that may be construed as abusive, exploitative, harras-y and aimed at excluding a specific group. We all have our own opinions and beliefs but, if yours are unkind to a specific group of people, do not use this site. This is a place of kindness and respect.

  • Not paying your fees or paying in an illegal manner

If rules are not adhered to, I reserve the right to remove your account and block you.

Confirmation of orders

If you do place an order through my site, firstly - THANK YOU! Secondly, your order should appear on your account and you should receive a confirmation email. If you do not receive this or if there are any errors, please inform me ASAP. I cannot accept responsibility for issues if I am not informed of them. 

Note that products on this site are delivered on a print-on-demand service and delivery is estimated based on supplier timeframes. I will let you know if your order is expected to be delivered later than set out in the description but cannot be held responsible for late deliveries as a result of 3rd party delays.

Third parties

Following on from the above, The Readily uses third party services to make sure things work smoothly and to supply bespoke bookish books on this website. Sometimes, third-parties make mistakes. I am very sorry if any of these mistakes affect you, but by using this service you agree that I am not at fault and I am not in breach of contractif things go wrong. I will endeavour to support you to resolve issues you may have when dealing with third party services. 

Membership

When you sign up as a member, you will be able to access the community forums and place orders in the shop. Memberships are currently all under one tariff (free). Membership levels, including paid memberships, may develop over time. In this case, our terms and conditions will be updated and you will remain on a free membership by default with the option to upgrade if you wish.

By creating an account, you agree that your account profile will be public and visible to other members of The Readily community.

Cancelling memberships

Apparently you can't delete your account yourself easily just yet on this platform. If you want to close your account, please use the contact form on the home page and I will complete this for you and confirm when this is done.

Product Descriptions

I try my best to provide clear, comprehensive descriptions on all products on offer. I shall update prices and/or descriptions as soon as an error has been identified. If I do have to cancel an order as a result of error, I will contact you with the details your have provided and let you know your options.

Things you post to this site

In addition to not stealing content from this site (my own as well as other community members) we ask you not to steal content from other sites and post it here. 

When you post to this site, you agree to the following:

Abide by the rules detailed above in the refusal of service section

Abide by the community standards set out in forums and any social media groups

Be polite to all other community users and moderators

Failure to adhere to these requirements may result in account suspension or removal.

Intellectual Property

Content I post remains my property. Content you post remains your property. As a user, you agree to respect the ownership of others content and not copy it.

 

The Readily will not have any ownership of anything you post on this site. If there is something I like, I will reach out to your directly to request use of or to offer an opportunity to guest write a story. The exception to this will be any reviews or testimonials - I reserve the right to use this to promote the site and let everyone know how awesome this place is.

Despite the rules and expected general decency of others, other users may occasionally steal content. If this does happen, I will support you as far as I can to give the person a right telling off, but I cannot be held legally responsible for the actions of someone else and you agree that I am not liable for the actions of others.

IMPORTANT:

You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of The Readily content or intellectual property, in whole or in part, without my prior written consent. 

If you do this, I reserve the right to remove you from the platform and I will let the community know here and on social media of your behaviour.

Cancelling or returning merchandise

If any part of your order is damaged, send me a photo of the damaged item(s) and packaging within 10 days of receiving it and if I am at fault I will take steps to replace the damaged item.

If the item is lost, please let me know and I will investigate with the delivery provider. 

Unless the product is damaged or is not what you ordered, I cannot accept a return. I understand this is a strong policy and I very much value your custom but I cannot be held accountable for consumer errors and/or consumer remorse. All items on this site are produced on demand and to bespoke designs and are not returnable unless they damaged/defective/not the correct item.  All apparel includes a size chart - I strongly recommend you follow this chart and advice provided by the supplier to ensure you order the right size - as all this information is clearly provided, I cannot accept exchanges/returns for incorrect orders.

 

If you really don’t want the item you have ordered, give it to a bookish friend as a gift, I am sure they'll appreciate it. 

Changing terms and conditions

I reserve the right to change these terms and conditions. The most recent T&C's are these ones.

Limitations of liability

By using this site and it's services you are agreeing that I am not at fault for any damage or injury that may arise from using this site and associated services. 

Legal Stuff

INDEMNIFICATION

You shall indemnify and hold me harmless from and against any and all losses, damages, settlements, liabilities, costs, charges, assessments, and expenses, as well as third party claims and causes of action, including, without limitation, attorney’s fees, arising out of any breach by you of any of these Terms and Conditions, or any use by you of the website or service. You shall provide me with such assistance, without charge, as we may request in connection with any such defence, including, without limitation, providing us with such information, documents, records, and reasonable access to you, as I deem necessary. You shall not settle any third party claim or waive any defence without my prior written consent.

 

EFFECT OF HEADINGS

The subject headings of the paragraphs and subparagraphs of this Agreement are included for convenience only and shall not affect the construction or interpretation of any of its provisions.

ENTIRE AGREEMENT; WAIVER

This Agreement constitutes the entire agreement between you and The Readily pertaining to the Site and Service and supersedes all prior and contemporaneous agreements, representations, and understandings between us. No waiver of any of the provisions of this Agreement by The Readily shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver. No waiver shall be binding unless executed in writing by The Readily.

RECOVERY OF LITIGATION EXPENSES

If any legal action or any arbitration or other proceeding is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party or parties shall be entitled to recover reasonable attorney’s fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.

SEVERABILITY

If any term, provision, covenant, or condition of this Agreement is held by an arbitrator or court of competent jurisdiction to be invalid, void, or unenforceable, the rest of the Agreement shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.
